Welcome to ComplainPoint, a Complaint Tracking System (“CTS”, “we”, “us”, “our”). By creating an account or using our platform, you agree to comply with and be bound by these Terms & Conditions. If you do not agree, you must not use CTS.
1. User Eligibility and Responsibilities
- You must be at least 18 years old or have legal capacity to enter into a contract.
- You are responsible for maintaining the accuracy of all information provided during registration, including organization name, email, phone number, and subdomain.
- You must ensure that your account credentials are kept confidential. Do not share your password or magic link with others.
- You agree not to misuse CTS, including submitting false complaints, impersonating others, or attempting unauthorized access to data.
- You agree to comply with all applicable laws and regulations while using the system.
2. Account Management
- Each organization or tenant must have only one primary administrator account. Additional staff can be added as sub-users.
- You are responsible for all actions performed under your account.
- We reserve the right to suspend or terminate accounts that violate these terms.
3. Data Privacy and Security
- CTS collects personal and organizational data necessary for operating the system.
- All data is stored securely, and we implement industry-standard encryption and security measures.
- We do not sell or share personal data with third parties except as required by law or as part of service delivery.
- Users must respect privacy and confidentiality of data belonging to other users or organizations.
4. Intellectual Property
- All software, content, logos, graphics, and materials on CTS are the property of ComplainPoint or its licensors.
- Users may not copy, reproduce, modify, or distribute CTS content without explicit permission.
- Tenant-generated content (complaints, comments, feedback) remains the property of the tenant, but CTS may use anonymized data for analytics and service improvement.
5. System Usage and Access
- CTS is provided “as-is” and “as-available”. We strive for uptime, but we do not guarantee uninterrupted service.
- Users should not attempt to reverse engineer, hack, or disrupt the system.
- We reserve the right to temporarily suspend access for maintenance or security reasons.
6. Limitation of Liability
- CTS is not liable for indirect, incidental, or consequential damages arising from the use or inability to use the system.
- We are not responsible for any complaints or data submitted inaccurately by users.
- You agree to use CTS at your own risk and assume full responsibility for your actions.
7. Indemnification
You agree to indemnify and hold harmless ComplainPoint, its affiliates, employees, and contractors from any claims, damages, or losses arising from your violation of these terms.
8. Modification of Terms
We may update these Terms & Conditions periodically. Changes will be effective immediately upon posting on the platform. Users are encouraged to review the terms regularly to stay informed.
9. Termination
- We reserve the right to terminate accounts for violations or misuse.
- Users may terminate their account at any time by contacting support.
- Upon termination, access to CTS and all associated data may be restricted or deleted according to our data retention policy.
10. Governing Law
These Terms & Conditions are governed by the laws of Bangladesh. Any disputes arising from the use of CTS shall be resolved under the jurisdiction of [Your City/Region] courts.
